Terms of Service

1. Acceptance of Terms

By creating an account, uploading documents, or using any feature within Rate My Resume, you enter into a legally binding agreement with Ryan Fernandes ("we," "us," or "our"). These Terms apply to all visitors, users, and others who access or use the App.

2. Eligibility & Account Registration

• Age Requirement: You must be at least 13 years of age (or the minimum legal age in your country) to use this App.
• Account Security: When you create an account, you must provide accurate information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Account Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that violates these Terms or is harmful to other users or the business interests of the App.

3. Description of Service & Credit System

Rate My Resume provides AI-driven resume analysis, job description alignment, and bullet point optimization.

• Pay-As-You-Go Credits: Access to deep audits and premium features requires the purchase of credits.
• No Expiration: Purchased credits do not expire unless your account is inactive for more than 24 consecutive months or the App is discontinued.
• Refund Policy: Due to the digital nature of AI processing power, all credit purchases are final and non-refundable once a credit has been consumed for an audit. If you experience a technical failure during processing, please contact support for credit restoration.
• Payment Processing: All payments are securely processed through our third-party payment gateway, Razorpay. We do not store or retain your financial details or credit card numbers.

4. User Content & Privacy

• Your Content: You retain full ownership of any resumes, job descriptions, or text you upload to the App ("User Content").
• License to Process: By uploading User Content, you grant us a temporary, worldwide, royalty-free license to parse, extract, and analyze the text solely to provide you with the App's features.
• Data Retention & Deletion: As outlined in the App's feature guide, audits are saved to your profile for your convenience. You may delete old analyses or account drafts at any time through the user interface, which will permanently remove them from our active database.
• AI Processing: Your data is processed using artificial intelligence models. Please refer to our Privacy Policy for detailed information on how your data is handled and secured.

5. Intellectual Property Rights

• Our Property: The App's design, code, hardware-accelerated animations, UI elements, logos, typography, and original content are the exclusive property of Ryan Fernandes and are protected by copyright and intellectual property laws.
• Restrictions: You may not clone, copy, reverse engineer, scrape, or extract the underlying code or prompt engineering frameworks of Rate My Resume without explicit written permission.

6. Prohibited Conduct

You agree not to:

• Upload resumes or documents containing malicious code, viruses, or harmful software.
• Use automated bots, scripts, or scrapers to generate mass resume audits or manipulate the credit system.
• Upload content that is defamatory, obscene, deeply offensive, or violates the intellectual property rights of a third party.
• Attempt to bypass or circumvent the Razorpay payment gateway.

7. Disclaimer of Warranties ("As Is")

• No Guarantee of Employment: Rate My Resume is an optimization tool designed to improve your resume's impact. We do not guarantee that using the App will result in job interviews, job offers, or career advancement.
• AI Accuracy: AI analysis is subjective. While we strive for high-quality recommendations, we do not warrant that the feedback, skill-gap analysis, or rewritten bullet points are entirely free of errors or perfectly aligned with every real-world recruiter's preferences.
• Service Availability: The App is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee uninterrupted or error-free operation of the service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Ryan Fernandes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of career opportunities, or device damage resulting from:

1. Your use or inability to use the App.
2. Any bugs, errors, or technical interruptions in the App.
3. Unauthorized access to or alteration of your user data.

In no event shall our total liability for any claims under these terms exceed the total amount paid by you to us for credits in the past six (6) months.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide notice within the App or via email before the new terms take effect. By continuing to access the App after those revisions become effective, you agree to be bound by the revised terms.

10. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Karnataka, India.
